What is litigation? Litigation is the process leading up to trial. If your case cannot get settled during the negotiations stage, it may end up in litigation. This includes the filing of the lawsuit, responding to interrogatories, conducting depositions, hiring experts, mediation, and much more.
The litigation process in an injury case is largely controlled by Florida’s Rules of Civil Procedure. The rules are long and detailed, and failure to comply with the rules can result in sanctions, or penalties. Some failures can even result in your case being thrown out. Hiring a firm comfortable with the litigation process is key to ensuring all deadlines are met and all rules are followed.

The litigation process is very lengthy. The entire process is supposed take 18 months from the date of filing. Realistically, Judges and Courthouses are extremely busy, so calendar space for hearings is limited. On top of that, any party can ask the Judge for a time extension, and it is at the Judge’s discretion to grant the extension. If the party has good cause to ask for the extension, the Judge will usually grant the time extension. This can cause trials to take place several years after a lawsuit was filed, rather than 18 months.

However, trial is not the only way a case can be resolved. Through all stages in litigation, your attorneys should continue negotiating with the defense attorney to resolve your case. Your attorney will keep you informed of any new offers and advise you whether to accept or reject the offer. You also have the opportunity to resolve your case at pre-trial mediation.
